Privacy Policy

This Privacy Policy (“Policy”) describes how Inflection.io, Inc. (“Inflection,” “we,” “us,” “our”) collects, uses, and discloses information from and about you when you interact with our website at www.inflection.io (the “Site”), the PLGTM community at www.plgtm.com/ (“Community”), our mobile app (the “App”), or use any of our services on which this Policy is posted (collectively, with the Site, Community, and App, the “Services”).

Please read this Policy carefully to understand how we handle your information. By browsing the Site or using the Services, you acknowledge that you have read and understand this Policy and that we collect, use, and disclose your information as set forth below.

If you are a resident of the European Economic Area (“EEA”) or the United Kingdom (“UK”), please see section 12 (Notice for EEA and UK residents) below for information specific to you.

1. Scope of this Policy

This Policy covers our treatment of the information that we collect when you use the Services. It also applies to information collected offline, for example through customer service calls or at an event. This Policy does not apply to the practices of entities that we do not own or control, individuals that we do not employ or manage, or other websites or digital services to which this Policy does not link.

2. Information we collect

We may collect the following types of information about you:

  • Information you provide to us. We may collect and store any information that you provide to us when, for example, you contact us, fill out a webform on the Site, post in the Community, otherwise input information into the Services, or otherwise provide us with information. This information may include, but is not limited to, your name, email address, phone number, and profile name; your age, date of birth, gender, and zip code; and your business contact information, such as your position and your business address, phone number, and email address. We may collect information when you interact with us on social media by, for example, “liking” or “sharing” our content. We may also collect any other information you provide to us in an email, call, Community post, or otherwise. You are not required to provide us with such information, but certain features of the Services may not be accessible or available, absent the provision of the requested information.

    Login credentials and payment information are managed by third-party service providers, so Inflection does not collect or store this information. When you enter login credentials or payment information, you are interacting with a third-party service provider, not Inflection.
  • Information collected automatically. When you interact with the Services, we may automatically collect information about your browser, device, and use of the Services. This information may include, but is not limited to, IP address, device type and model, operating system, cookie identifiers and other similar identifiers such as device identifiers, browser type, clicks, frequency and length of time you interact with the Services, website and app pages visited, and navigation through those pages. Some of this data is collected using cookies and similar technologies. To learn more about these technologies and your choices regarding them, please see the section below titled “Your Choices.”
  • Information collected from affiliates and third parties. We may collect information about you from other sources, including affiliates, business partners, marketers, and data compilers.

3. How we use your information

We may use the information we collect for any of the following purposes: 

  • To provide, maintain, and improve the Services;
  • To provide customer support and respond to your inquiries;
  • To communicate with you about updates, surveys, offers, and other information related to our Services, subject to any opt-out preferences you have communicated to us;
  • To manage and remember your preferences and customize the Services;
  • To research and analyze the functioning and use of the Services;
  • To authenticate you and allow you to log into your account (as explained above, login credentials are collected and processed by a third-party service provider, not by us);
  • To process orders and complete transactions (as explained above, payment information is collected and processed by a third-party payment processor, not by us);
  • To advertise and market our services to you, including on third-party websites and via email (subject to any opt-out preferences you have communicated to us);
  • To understand and resolve technical and security issues;
  • To comply with legal requirements, relevant industry standards, and our policies;
  • To protect the safety, rights, property or security of Inflection, our users, employees, third parties, members of the public and/or our Services, including by preventing fraud and malicious or illegal activity;
  • To enforce our terms and policies; and
  • For any other purpose with your consent.

We may combine information that we collect from and about you (including automatically generated information) with information that we obtain about you from third parties and use such combined information in accordance with this Policy.

We may aggregate, de-identify and/or anonymize any information collected through the Services so that such information is no longer reasonably capable of being associated with you. We may use such information for any purpose and share such information for any purpose with any third parties, in our discretion.

4. How we disclose information

We disclose the information described above as follows:

  • Internally or with Affiliates. Your information may be accessible to Inflection employees and our affiliates.
  • Service providers. We may disclose your information to third parties that provide business, professional, or technical support functions on our behalf. They may provide a variety of services to us, including website hosting, data storage, information security, user authentication services, payment processing, marketing and advertising, consulting, and data analytics.
  • Business partners. We may disclose your information to business partners, such as entities that provide sponsoring or partner with us for joint marketing activities.
  • Other third parties. We may disclose your information to other third parties that may use your information for their own or others’ purposes.
  • Legal matters and safety. We may disclose your information as we, in our sole discretion, believe necessary or appropriate to respond to legal process, provide information to law enforcement or regulatory agencies, or in connection with an investigation on matters related to public safety; to address a violation of our terms or policies; or to protect the rights of Inflection, our employees, or any third party.
  • Business transfers. We may disclose your information if we undergo organizational restructuring such as a sale, merger, or acquisition; in the event of insolvency, bankruptcy, or receivership; or in contemplation of transactions, such as in due diligence. If any of our assets are sold or transferred to a third party, your information may be one of the transferred business assets.
  • With your consent or at your direction. We may disclose your information if we have your consent to do so.

5. Your Choices

Cookies and similar technologies. When you interact with the Services, we (and third parties acting on our behalf) may automatically collect certain information about your browser, device, and use of the Services through cookies and other similar technologies. Cookies are small text files stored on your browser or device, which allow us to provide certain features of the Services, personalize your user experience, and advertise our Services to you. Your browser may allow you to manage your cookies and local storage. Because each browser is a little different, we encourage you to check your browser’s “Help” feature to learn how to manage cookies. Please note that if you block or otherwise reject cookies or other similar technologies, certain features of the Services may not function as expected.

Tailored advertising. We may engage third parties to serve tailored advertisements for our Services on our behalf on third-party websites and applications. You have certain choices about how your information is used for this purpose.

  • For more information about tailored advertising or to opt out of participating companies, please visit the Digital Advertising Alliance’s (DAA) opt-out program at www.aboutads.info/choices or the Network Advertising Initiative’s (NAI) opt-out page at https://optout.networkadvertising.org/. We make no representation about the accuracy or effectiveness of these opt out mechanism. Opting out of tailored advertising does not prevent you from seeing ads for our Services online; instead, the ads you see are not based on your interaction with the Services.
  • Some tailored advertising is carried out using cookies. You may be able to set your browser to refuse certain types of cookies, or to alert you when they are being used. Please consult the "Help" section of your browser for more information. However, if you block or otherwise reject cookies or other similar technologies, our Services may not function as expected. Because we and third parties may use non-cookie technologies with your browser or device, browser settings that block cookies used in isolation may not affect the functioning of those technologies.
  • Mobile devices often include settings to help you manage how your device collects and shares information for advertising purposes. For more information on how to manage those devices settings, please visit the Network Advertising Initiative’s mobile choice page at https://www.networkadvertising.org/mobile-choice.
  • Please note that modifying your mobile device or browser settings or opting out of tailored advertising using your web browser may have different results depending on the type of device or web browser you are using and the version your device’s operating system. Opting out is generally effective only on a device-by-device or browser-by-browser basis. If you use more than one browser or device, the effect of any opt-out mechanism you use may be limited to the device on which you used the mechanism.

“Do not track” signals. “Do-not-track” (“DNT”) is a setting offered by some browsers. DNT signals are not yet uniform, so Inflection, like many other website operators, does not currently recognize or respond to DNT signals.

Social media. To control the information you share with us when you follow us, like our posts, or otherwise interact with us on social media, you can adjust your social media account settings related to how your information is shared.

Marketing communications. You may opt out of our marketing communications by email, direct mail, and phone at any time. You may opt out as follows:

  • Emails. If you receive marketing emails from us, you may unsubscribe at any time by following the instructions contained within the email. Note that you may continue to receive transaction-related emails regarding products or Services you have requested. We may also send you certain non-promotional communications regarding us and our Services and using the unsubscribe link will not halt those communications (for example, communications regarding our Services or updates to our Policy).
  • Direct mail and phone calls. If you do not want to receive marketing mail or phone calls from us, please email us at support@inflection.io to request to opt out of these communications.

SMS/Text messages. If you provide us with your mobile phone number and consent, we may send you SMS/text messages for marketing purposes. To opt out of marketing text messages, reply “STOP” to our marketing text messages. This will not prevent us from sending you SMS/text messages for non-marketing purposes; for example, if  we enable two-factor authentication, and you enable this feature on your account and choose to receive a code by text message, we may still send you such codes.

Push notifications. If you opt in to receive push notifications, we will send you push notifications. If you no longer wish to receive these types of communications, you may turn them off through your device settings.

Online analytics. We may use third-party web analytics services, such as those provided by Google Analytics. These service providers use cookies and other technologies described in this Policy to help us analyze how users use the Site. For more information on how Google Analytics uses data from our Site and how you can control the information sent to Google, click here. To prevent Google Analytics from using information for analytics, you may install the Google Analytics Opt-Out Browser Add-on by clicking here. Because these opt outs are cookie-based, please note that if you get a new device, install or start using a new browser, or erase or alter your browser’s cookie file, you may need to opt out again.

6. Security

We take physical, administrative, and technical steps to help protect your information. While we take efforts to protect the integrity and security of our network and systems, no security measures are perfect, so we cannot guarantee the security of your information.

You should take steps to protect against unauthorized access to your account by, among other things, signing off after using a shared computer, choosing a complex password, and keeping your login credentials private. We are not responsible for any lost, stolen, or compromised passwords or for any unauthorized account activity. You are responsible for all activity that takes place under your account, including any unauthorized activity.

In addition, by using the Services, you agree not to knowingly or intentionally compromise the security of the Services by, for example, uploading files that contain viruses, malware, bugs, Trojan horses, or any other form of technology that could impair the security or functionality of the Services.

7. Data retention

As a general matter, we retain your information for as long as you keep an account with us. In certain situations, we will delete your information after it is no longer needed to provide a feature or service. We also keep information, including information submitted by individuals without an account, for as long as necessary for our legitimate business interests and/or as needed or permitted for legal reasons.

8. Your rights

Depending on your jurisdiction of residence, you may have the right to make certain requests of us regarding your information, including the right to request access, correction, deletion, or certain information about the information we hold about you.

To request to exercise a right that you are granted under your jurisdiction’s law, please email us at support@inflection.io. Please explain the right you want to exercise and the data with respect to which you want to exercise that right. We will respond to your requests required by applicable law. We may request specific information from you to help us confirm your identity and process your request. Applicable law may require or permit us to decline your request.

9. Third-party links and content

The Services may have links to third-party websites, apps, or communities that may have privacy policies that differ from ours. We are not responsible for the practices of such sites, apps, or communities. You should check third parties’ privacy policies before interacting with third party websites, apps, or communities and providing third parties with your information. 

Likewise, the Services may have third-party content, for example, in posts in the Community. We do not make any representations concerning the accuracy of such information and are not responsible in any way for third-party content on our Services. You interact with third-party content at your own risk.

10. Children’s privacy

The Services are not intended for children under the age of 13, and we do not knowingly collect any “personal information” (as defined in the U.S. Children’s Online Privacy Protection Act or “COPPA”) from children under 13. If we learn that a child under the age of 13 has provided us with personal information, we will delete such information in accordance with applicable law.

11. Notice for non-United States residents and consent to transfers

Inflection and our computer systems are based in the United States, so we will process your information in the United States, where the privacy laws may not be as protective as those in your jurisdiction. To understand your rights with regard to your data, please visit the website of the appropriate data protection authority for your region. By using the Services, you agree to this Policy and you understand and agree to the transfer of your information to the United States and to the processing of that information as described in this Policy. 

Where required, we will use appropriate safeguards for transferring the data of residents of the EEA or UK.  This includes signing Standard Contractual Clauses that govern the transfers of such data. For non-EEA/UK residents, we will transfer your data in accordance with applicable law.

12. Notice for EEA and UK residents

This section only applies to Users who are residents of the EEA or UK. For purposes of the EU General Data Protection Regulation (“GDPR”) and the UK GDPR, Inflection is a data controller as defined in these laws with regard to any data we collect directly from and about you that can be used to personally identify you (“Personal Data”). We are a Processor with regard to Personal Data that we process on behalf of our customers, and this Policy does not govern the Personal Data we process on behalf of our customers. Please contact the appropriate customer for details on how they process your Personal Data. 

Legal basis for processing. As explained above, we use Personal Data in various ways depending on your use of and/or participation in our Services.  We may process your Personal Data in reliance on one or more of the following legal bases, depending on the circumstances: (1) with your consent; (2) as necessary to perform our agreement to provide services; (3) where required by applicable law; or (4) where we have a legitimate interest.

Your rights. EEA and UK residents have the right to request:

  • To access your Personal Data, receive a copy of it, and request the correction or completion of your Personal Data if it is inaccurate or incomplete;
  • Deletion of your Personal Data, subject to certain exemptions and any legal or other rights we have to retain certain Personal Data;
  • To have us transmit your Personal Data to another data controller, where technically feasible;
  • To withdraw consent to processing, where our basis for processing your Personal Data is your consent; and
  • To restrict the processing of your Personal Data and object to our processing of it in certain situations.

To request to exercise any of these rights, please email us at security@inflection.io . As mentioned above, we will respond to your requests as required by applicable law. Applicable law may permit or require us to deny all or part of your request.

We encourage you to contact us directly and allow us to work with you to address any concerns you might have about our privacy practices. However, you have the right to lodge a complaint with a competent data protection supervisory authority if you consider that the processing of Personal Data relating to you infringes applicable data protection laws. If you are a UK resident, you have the right to lodge a complaint with the Information Commissioner’s Office. 13. Changes to this Policy

We may change this Policy from time to time. If we make any changes, we will change the Last Updated date above. We encourage you to read this Policy carefully and regularly check for changes. You acknowledge that your continued use of the Services after we publish changes to this Policy means that the collection, use, and sharing of your information is subject to the updated Policy.
